Probate

Probate is the legal process of releasing funds from the deceased’s bank accounts, and other investments and property. It is the responsibility of the person named as the Executor in the Will to administer the estate in accordance with the terms of the Will and it is they who will need to apply for Probate. If Probate is required, the estate has to be administered in accordance with the intestacy rules.

It can be particularly stressful and time-consuming. Your lawyer will take on this job for you, using his/her considerable skills to speed and ease the process in an efficient and sympathetic manner.

Usually the next-of-kin will register the death and make funeral arrangements, and these tasks may be carried out by people other than the Executor. FAQs

Do I need to use a Solicitor for Probate?

No. You can process your application online now with HMCTS. However, again the estate may not be a simple estate so always seek legal advice initially. If you personally apply for the Grant of Probate you are personally liable for the information given.

How long will Probate take?

How long is a piece of string? There is no set time limit. Once the application has been submitted, if on-line it can take between 10 to 14 days to be issued.
